Comrades:

Although this meeting last only half a day, it contains lots of information, and has achieved prospective results. We have studied the Notice of the Fifth Five Year Plan to carry out law publicity and education among the citizens by the Publicity Department, CCCPC and the Ministry of Justice, transmitted by CCPCC and the State Council, and the spirit of the sixth national law publicity and education working meeting. We invited the advanced units in law popularization, YRCC and Water Resources Department of Sichuan, to introduce their beneficial experience and methods of law popularization in the “Fourth Five Year Plan” period, furthermore, we checked and approved the Fifth Five Year Plan of law publicity and education in national water resources system. After the meeting, the Office of Law Popularization of the Ministry shall make modifications according to the suggestions raised by everybody, and shall distribute the plan in the form of document of the Ministry to guide the law popularization work in local districts.

Then I would share with you some of my views on the implementation of law popularization in the “Fifth Five Year Plan” period by the water conservancy system and the work of water law publicity and education.

1. Law popularization in the “Fourth Five Year Plan Period” has achieved obvious results

During the law popularization of the “Fourth Five Year Plan” period, guided by the important thoughts of “Three Representatives” and the spirit of the Sixteenth National Congress, as well as its third and fourth meetings, the national water conservancy system stuck to the principle of the combination of concentrated publicity and regular publicity, the combination of law study and law utilization, and the combination of law popularization and control in accordance with laws. Focusing on the central work of reform and development in the new phase, we carried out abundant publicity and education activities in different forms, realized the targets set in the Fourth Five Year Law Popularization Plan, and promoted the progress of administration according to law and water control according to law. The work of law popularization and control according to law has achieved obvious results.

First of all, the consciousness of water eventualities and water law of the whole society is strengthened. Through such water law publicity and education activities as “World Water Day”, “China Water Week” and “Memorial Day of Water and Soil Conservation Law”, the concepts of harmonious coexistence between human and water has filtered into people’s minds. Water is the basic resource for human existence and economic and social development, the concepts of the sustainable utilization of water resources to guarantee the sustainable development of economy and society has become the common cognition and behavior of the whole society. The consciousness to abide by water law and regulations is further strengthened.

Secondly, the legal makings of the stuff in water conservancy system are improved. Water administrative departments at all levels and basin management departments have established many law study and training systems such as law study system of the theory study center group of leaders and cadres, law study and examination system of organ stuff, and law training, examination and job competition system of water administrative stuff. They also stuck to the combination of basic water knowledge study and specific knowledge study, and the combination of law test and examination and work license. Through education and training, the legal makings of the cadres and stuff of water conservancy systems have been further improved, and the self-consciousness and capability of law enforcement and work according to law has been further enhanced.

Thirdly, the capability of administration according to law of water administrative departments at all levels has been improved. Water laws as New Water Law has come into effect in succession, perfecting the water law and regulations system. The reform of water administrative examination and approval system is deepened, and a new mechanism of administrative permit standardization is initially established. We adhered to the scientific concept of development, established such water administrative systems as water intake permit and water resources demonstration, strengthened water capital construction planning and funds management, enhanced the construction and management of water projects, and strictly implemented project legal person responsibility system, bid invitation and submission system, and construction supervision as well as management system. We have made government affairs public, implemented administrative law enforcement responsibility system, strengthened law enforcement, improved the capability of administration according to law, and promoted the transformation of government functions and the construction of a service government.

2. Fully realize the significance of the well completion of law popularization in the “Fifth Five Year Plan” period

The “Eleventh Five Year” period is a key period to carry out the scientific concept of development, and put forward sustainable development of water resources. On one hand, we shall satisfy the economic and social demand for water resources through the development of water resources. On the other hand, promote the transformation of economic growth pattern, and facilitate economic and social development to step into the pathway of scientific development through the transformation of water resources development pattern. Carrying out scientific concept of development, building a government under the rule of law, and promoting the sustainable development of water resources provided a beneficial chance for water law popularization, and set up new and higher standards.

Law publicity and education is a basic work to improve the legal makings of the entire population, promote the implementation of state affairs management according to law, and the construction of a socialist country under the rule of law. To continue water law publicity and education, it is significant to build a favorable legal environment, form a social atmosphere of cherishing water, protecting water, and saving water, improve the legal makings of the cadres and stuff especially leaders and cadres at all levels in water conservancy system, and further strengthen the capability of water administrative departments at all levels to make decision and manage according to law. We shall comprehensively carry out scientific concept of development, guarantee and promote the high degree of sustainable development of water resources, realize the significance of facilitating water law publicity and education, boost the sense of responsibility and mission, and firmly carry on the law popularization in the “Fifth Five Year Plan” period.

3. Try to finish the targets and tasks set in the Fifth Five Year Law Popularization Plan by water conservancy system

The guideline and target of Fifth Five Year Law Popularization Plan is: guided by Deng Xiaoping Theory and the important thoughts of “Three Representatives”, carry out the spirit of the Sixteenth National Congress, and the third and fourth meeting of the Sixteenth National Congress, abide by the requirements of administration according to law and the construction of government under the rule of law, focus on the targets and task of the construction of a water-saving society and sustainable development of water resources, adapt to the requirements of water harnessing and management according to law raised by economic and social development and the transformation of economic growth pattern, further improve the water law makings and the awareness of water eventualities, create a favorable social atmosphere of abiding by water regulations consciously, cherishing water, and protecting water, further improve the law makings of the cadres and stuff of water conservancy system, especially leaders and cadres, civil servants, and water administrative and law enforcement personnel, strengthen the capability of decision making and administration according to law, try to realize the transformation of leading and management pattern, further enhance the consciousness of administration, harnessing and management according to law of water administrative departments, basin management organizations, and other organizations, and improve the capability of applying legal methods to social management and public service.

In order to finish the tasks set in the Fifth Five Year Plan, we shall focus on the following five aspects:

Firstly, focus on the study and publicity of the Constitution, and try to improve the awareness of Constitution by the cadres and stuff of water conservancy system. The Constitution is the fundamental law of our country, and is the general regulations to manage state affairs. A thorough study and publicity of the Constitution is a basic and fundamental work in law publicity and education. We shall carry out a series of important denotations and spirits on carrying out the Constitution by Hu Jintao, General Secretary of the CPC Central Committee, form an upsurge of learning and carrying out the Constitution in water conservancy system, and form a favorable atmosphere of upholding, observing, and sticking up for the Constitution.

Secondly, study and publicize water regulations thoroughly, and try to create a well water legal environment. Water Law, Flood Prevention Law, Water and Soil Conservation Law, and Flood Prevention Ordinance, Water Intake Permit and Water Fee Collection and Management Ordinance constitute a relatively perfect water regulations system, which provides a legal guarantee for the sustainable utilization of water resources. We shall further strengthen the study and training of water regulations, improve the water law makings of the cadres and stuff of water conservancy system, and promote the innovation of water administrative pattern. Extensively publicize the principles and policies of the Party and the state on water resources management and sustainable utilization of water resources, publicize the importance and pressure for water control according to law, cultivate the awareness and concepts of water law, increase water law makings, strengthen the consciousness to observe water regulations, and promote sustainable development of water resources and the construction of resource-saving and environmentally friendly society.

Thirdly, conduct concentrated publicity, and try to promote the transformation of water use concept. We shall fully utilize “World Water Day”, “China Water Week”, and the anniversaries for such laws and regulations as Water and Soil Conservation Law, carry out water law publicity and education activities loved by the mass, publicize the new methods of water harnessing and the concept of the harmony between human beings and the nature which aims at implementing scientific concept of development, increase the cognition of the fundamental role of water resources in the sustainable development of social economy, strengthen the awareness of water eventualities and water saving of the whole society and citizens, promote the transformation of water use concept, push forward the construction of a water-saving society, form a social fashion of cherishing water, protecting water and saving water, and create a favorable social environment for the sustainable development of water resources.

Fourthly, focus on the key objects of publicity and education, and try to improve the capability of administration according to law of water administrative departments at all levels. Intensify the publicity and education of leaders, cadres, public servants, and water administrative personnel, enhance the study and training of such laws and regulations guiding the administrative behaviors of administrative organs, public servants, and administrative and law enforcement personnel as Administrative Penalty Law, Administrative Permit Law, Administrative Reconsideration Law, Administrative Litigation Law, National Compensation Law, Public Servant Law, and Legislation Law, further improve the consciousness of administration according to law of water administrative departments at all levels and basin management organizations, set up the concept of law enforcement for people, consolidate the concept that responsibility accompanies rights, the utilization of rights shall be supervised, lawbreakers must be prosecuted, and act of tort shall be compensated. Promote strict, fair and civil law enforcement, and ensure the appropriate implementation of national laws.

Fifthly, stick to the combination of law popularization and control according to law, and promote the progress of administration and water control according to law of water conservancy system. We shall carry out Overall Promotion of the Implementation Compendium of Administration according to Law and Some Opinions of the General Office of the State Council on the Promotion of Administrative Law Enforcement Responsibility System, stick to the combination of law popularization and control according to law, accelerate the construction of water regulations system, standardize administrative permit, establish a healthy water management system, make government affairs public, implement administrative law enforcement responsibility system, gradually establish a water administrative law enforcement system of well defined power and responsibility, standardized behaviors, effective supervision and powerful guarantee, appropriately cope with the internal contradiction of people, strengthen the social management and public service of water-related affairs, and comprehensively promote administration and water control according to law.

Fourthly, strengthen the implementation of law popularization of the “Fifth Five Year Plan” period in the organization and leadership of law popularization of the “Fifth Five Year Plan” of water conservancy system. The key to gain results is to strengthen organization and leadership, to be earnest and down-to-earth, and ensure the successful completion of law popularization in “Fifth Five Year Plan” period.

Firstly, improve leadership mechanism and work mechanism, and ensure the implementation of organization. Establishing and perfecting leading organization and working body is a successful experience in law popularization in the “Fourth Five Year” period. We shall adjust the leading organization and working body according to the working demand and personnel changes. The Ministry has adjusted the members of law popularization meetings and law popularization office. The provincials shall establish and perfect the leading organization and working body, clarify the responsibilities of the leaders, bring the control according to law into the agenda of this unit, prepare before and examine later, guarantee the implementation of the plan, and push forward the development of control according to law.

Secondly, lose no time to frame plans, and push forward the implementation of all the tasks. After the delivery of the Fifth Five Year Plan of law publicity and education in national water resources system, every unit shall frame the law popularization plan of this unit according to the reality, and comprehensively start law popularization. At the same time, we shall set out annual main points of law popularization according to the targets and tasks set in the plan, disassemble the targets and tasks into concrete items, put a deadline to each item, intensify working methods, clarify responsibilities and requirements, and ensure the overall implementation of the plan.

Thirdly, guarantee the working funds of law popularization. Law publicity and education is a social public undertaking with long-term strategic significance. Each prefecture and each unit shall bring the working fund of control according to law into the financial budget of this department. Special fund shall be used specially to endure the success of control according to law.

Comrades, law publicity and education is a long-term but arduous task, an important guarantee for administration and water control according to law, and a beneficial social project. Whether the targets and tasks set in the plan could be realized shall depend on the leadership and implementation. I hope each unit shall strengthen the leadership to this work, strictly organize the work, and focus on the implementation. Let’s stick to the scientific concept of development, work hard, implement the law popularization plan of the “Fifth Five Year Plan” in water conservancy system, promote administration according to law in water conservancy system, and make new contributions to the construction of a government under the rules of law.
